Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Nudge ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Nudge is a mobile application that:

• Receives approval requests from AI coding tools (Claude Code) via push notifications
• Enables one-tap approval or denial of tool actions from your phone
• Delivers your response back to the AI tool in real-time via Firebase Realtime Database
• Pairs with CLI tools using a secure, time-limited pairing code

3. Account and Subscription

3.1 Free Plan

• Up to 30 events per day (resets daily at midnight UTC)
• Claude Code supported (more tools coming soon)
• 1 device
• 24-hour event history
• No registration or account creation required — anonymous authentication

3.2 Pro Subscription

• Price: $4.99 per month or $39.99 per year (subject to change)
• Features: Unlimited events (no daily cap), all AI coding tools supported
• Billing: Auto-renewable subscription through Apple App Store
• Renewal: Automatically renews unless canceled at least 24 hours before the end of the current period
• Payment: Charged to your Apple ID account upon purchase confirmation
• Cancellation: You may cancel anytime via App Store subscriptions in iOS Settings
• No Refunds: Payments are non-refundable except as required by law

3.3 Managing Subscriptions

To cancel or manage your subscription:

1. Open iOS Settings
2. Tap your name > Subscriptions
3. Select Nudge
4. Tap "Cancel Subscription"

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not reverse engineer, decompile, or disassemble the App
• Not abuse or exploit the service (e.g., excessive API calls, automated abuse)
• Comply with Apple's Terms of Service
• Not use the App to circumvent security controls in your development environment
• Review approval requests carefully before approving — Nudge relays requests but does not validate their safety

5. Service Architecture

Nudge uses the following infrastructure to deliver its service:

5.1 Firebase Cloud Messaging (FCM)

• Purpose: Push notification delivery
• Processing: Notification payloads are end-to-end encrypted (AES-256-GCM). Sensitive fields (tool input, description, working directory) are encrypted client-side before transmission and decrypted only on your device.

5.2 Firebase Realtime Database

• Purpose: Real-time delivery of approval responses from mobile back to CLI
• Connection: WebSocket-based real-time listeners with automatic reconnection

5.3 RevenueCat

• Purpose: Payment processing and subscription management

6. Intellectual Property

6.1 App Ownership

Nudge and all related materials are owned by EnterX LLC. All rights reserved.

6.2 User Data

Your approval events and development workflow remain your own. We do not claim ownership of any data that passes through Nudge.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Uninterrupted or error-free notification delivery
• Timely delivery of approval requests (network conditions may vary)
• Fitness for a particular purpose
• Availability of push notification infrastructure (APNs, FCM)

Notification delivery depends on:

• Network connectivity of both the CLI and mobile device
• Apple Push Notification Service availability
• Firebase Cloud Messaging availability
• Device notification settings and power management

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTERX LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or development time
• Service interruptions or delayed notifications
• Actions taken by AI coding tools after approval (Nudge relays your decision but does not control tool behavior)
• Push notification infrastructure failures (APNs, FCM)
• Consequences of approving or denying tool actions

9. Rate Limits and Fair Use

• Free plan: 30 events per day (resets at midnight UTC)
• Pro plan: Unlimited events
• Event data is retained for 24 hours
• Excessive or abusive usage may result in service restrictions

10. Account Deletion

You may delete your account at any time:

1. Open Nudge > Settings
2. Tap "Delete Account"
3. Confirm deletion

This permanently removes all your data from our servers: user profile, approval events, pairing codes, and device tokens.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon:

• Posting updated Terms in the App
• Updating the "Last Updated" date

Continued use of the App after changes constitutes acceptance of modified Terms.

12. Service Modifications or Termination

We reserve the right to:

• Modify or discontinue the App (temporarily or permanently)
• Change subscription pricing with 30 days' notice
• Terminate service for violations of these Terms

13. Privacy

Your use of Nudge is also governed by our Privacy Policy. Please review it at:

14. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be resolved in the courts of Tokyo, Japan.
